1. Acceptance of Terms

By using RunPH.org, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, including our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and RunPH.org ("we," "us," or "our").

2. User Conduct

a. Prohibited Activities

You agree to use RunPH.org only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes, but is not limited to:

• Using the Site in any way that is unlawful, illegal, fraudulent or harmful.
• Collecting or harvesting any personally identifiable information, including account names, from the Site.
• Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Interfering with or disrupting the operation of the Site or the servers or networks used to make the Site available.
• Attempting to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site.
• Using any data mining, robots, or similar data gathering and extraction methods in connection with the Site.
• Posting or transmitting any content that is unlawful, harmful, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

b. Responsible Use

You are responsible for your use of RunPH.org. Please use the Site responsibly and respectfully towards other users and the community.

3. Intellectual Property Rights

The content on RunPH.org, including but not limited to text, graphics, logos, images, and software, is owned by or licensed to RunPH.org and is protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the content on the Site without the prior written permission of RunPH.org.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use, subject to these Terms.

4. Disclaimer of Warranties

RunPH.org is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make the Site available are free of viruses or other harmful components. We do not warrant or make any representations regarding the use or the results of the use of the content on the Site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise.

Specifically, RunPH.org provides event listings for informational purposes only. We do not endorse, guarantee, or take responsibility for the actual conduct, safety, or organization of any listed event. Runners are advised to verify event details independently with the event organizers and participate at their own risk.

5. Limitation of Liability

To the fullest extent permitted by applicable law, RunPH.org shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party; (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Site, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In jurisdictions where limitations of liability are not allowed or are limited, RunPH.org's liability will be limited to the maximum extent permitted by law.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.

7. Dispute Resolution

Any disputes arising out of or in connection with these Terms or your use of RunPH.org shall be resolved through amicable negotiations. If negotiations fail, such disputes shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in the Philippines.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
